Terms and Conditions for Art Appraisal Services by Art Bay Auctions Welcome to Art Bay Auctions (“Art Bay” or “we”). We provide art valuation services for your artwork (“Artwork”) under the terms and conditions outlined below. By using our services, you (“you” or “your”) agree to comply with these terms. Please note that these terms may change without notice.

Appraisal Method: You will notice that on each work of art, there will be a complete description of the work, its registration number, and our price for the work. Our appraisal represents our opinion of the price a willing buyer would pay a willing seller to acquire the artwork, with neither being under compulsion to sell or buy. In making this determination we rely on gallery prices of reputable art galleries and other reliable price data and lists. We do not rely on third-party auction prices or internet prices to arrive at the appraised value.

 

  1. Our online appraisal services are based solely on the information and images you provide. The accuracy of your provided information significantly affects the appraisal outcome. Online appraisals cannot match in-person appraisals in detail.
  2. This appraisal represents our opinion of the price a willing buyer would pay a willing seller to acquire the artwork, with neither being under compulsion to sell or buy. In making this determination we rely on gallery prices of reputable art galleries and other reliable price data and lists. We do not rely on third-party auction prices or internet prices to arrive at the appraised value.
  3. We offer an appraisal report with a retail replacement price based on the information provided. We may refuse an appraisal at our discretion.
  4. The appraisal excludes reserve prices, sales costs, commissions, and taxes. It reflects the gross buyers’ willingness to pay, excluding expenses.
  5. You ensure the accuracy of your artwork’s information. Art Bay isn’t responsible for errors due to incorrect information. You’re expected to provide relevant documents (invoices, certificates, etc.).
  6. By providing images and material, you warrant ownership and grant us a license to use them. You warrant your authority to request an appraisal report and that your artwork isn’t encumbered.
  7. Art Bay doesn’t guarantee authenticity, origin, or condition. The estimate doesn’t assure sales results. Art Bay’s liability for errors is limited to the fee paid.
  8. By paying, you agree to these terms and acknowledge market fluctuations. The report reflects a specific date.
  9. If you disagree, do not proceed. For disputes, U.S. laws apply. Claims against Art Bay go to U.S. courts.
  10. You indemnify Art Bay against third-party claims arising from the appraisal report.
  11. Your payment signifies agreement. This document covers the appraisal service and constitutes the full agreement.
  12. It is important to note that an on-site inspection of the item has not been conducted by our appraiser. The determination of value has been based solely on the accuracy of the information furnished to the appraiser, including dimensions, medium, artist attribution, and condition, among others. It is essential to clarify that this appraisal is for retail replacement price.
  13. Art Bay assumes no liability for claims that our appraisal is inaccurate or incorrect in any respect or for any incidental or consequential damages including but not limited to alleged loss of profits or loss of increase in value. We do not assume any liability for (i) insurance losses, or (ii) claims for refunds or monetary damages based on a claim that our appraised value is too high, too low, or otherwise inaccurate. In the event of any dispute regarding this appraisal, our maximum liability shall be to refund the price paid for the appraisal.
